Travel Agent or Tour Organiser?
The Package Travel and Holiday Regulation 1992, defines a Tour Operator (or Organiser) as one who combines two or more elements of travel.
As Travel Agents find their feet in the evolving dynamic packaging field, they are increasingly becoming exposed to the realisation that they themselves are potentially tour organisers!
If they are shrewd, the travel agent has had the foresight to buy the right insurance for their company to provide for their changing circumstances, because few agents these days only advise clients on tour operators out of the brochure products. To retain their client, agents have had to go that step further and make their own packages from specialist consolidators.
The moment a travel agent makes this transition, in the eyes of the regulations, he has leapt from the status of “agent” to “principal”. In doing so, he has become the “tour organiser” and opened both himself and his company up to all liabilities arising not only from his own errors and omissions, but the acts of all of the suppliers to the package.
Suddenly the travel agent is responsible for the slip by the pool, the food poisoning in resort, the safety of the coach transfer; everything that is included in the package becomes his legal liability.
Buying the right insurance for the travel agent has never been more important. If you ever make a package, ensure that your liability insurances include the definition of Tour Operator, to prevent facing a very hefty legal bill and even bigger compensation awards.

FSA to regulate sale of travel insurance

Following the Treasury’s review of travel agents sale of travel insurance the FSA will be responsible for regulation of policies sold alongside a holiday.
For travel agents aligned to travel insurance specialist insure2travel this will not be a problem.
Currently insure2travel have over 1000 Agents or Introducers transacting on several types of facilities, all of which will still be suitable for travel agents or tour ops from 2009. As we also provide services to Brokers all our facilities are built to deliver FSA documents as required, travel agents will just need to print the additional documents supplied.

Insure2travel best for medical conditions
In a survey carried out in June by the Charity BCA (British Colostomy Association) insure2travel came out top for rates and cover for medical conditions. The article appeared in the charity publication ‘Tidings’ for summer 2007 issue 6. The survey was for Annual cover for a couple in aged 50 with medical conditions, the results are shown below.

Terrorism Cover now included
All insure2travel policies now provide cover for terrorism in respect of Medical Expenses and Personal Accident.
The exclusion for terrorism was removed from the policy from 01 July. The online wordings have been updated, hard copy wordings in circulation remain valid and will be updated at reprint.
Only 15% of travellers in the UK have any terrorism cover so this is a welcome extension to cover. |

Foreign Office Warning
Short haul travellers are neglecting to take travel insurance. The UK Foreign Office has warned British consumers that, half of all people going on short breaks this year are not taking out travel insurance. The government has issued a warning to consumers, citing all the possible reasons why they might need travel insurance. Recent figures showed that an air ambulance from the US East coast could cost £30,000 back to the UK and up to £16,000 back from Spain. Medical expenses in North America for heart surgery can cost $500,000 and more. |

Credit Card Cover
Many people are travelling without adequate travel insurance in the mistaken belief they have cover. Credit card travel insurance cover in particular often only provides cover for Personal Accident, and that is not much good without Medical Expenses cover. If your client says they have cover on their card ask them to check the cover and conditions very carefully as many of them have conditions and exclusions beyond what we believe to be reasonable. |
Gap/Long-stay
Budget long stay cover is often unsuitable for the type of trips undertaken. The insure2travel Long Stay policy is the same quality coverage as the Single Trip and Annual policies and remember the cover is available up to age 65! If you are competing for Long Stay insurance remember the insure2travel cover is comprehensive and covers a wide range of activities. |

Insurance essential for luggage-laden Brits
Insurers have urged British holidaymakers to buy travel insurance following research that found one in eight people have misplaced a possession while overseas in the last 12 months. According to the Insurers, items such as digital cameras, designer sunglasses wallets, mobile phones and luggage are the most common objects that go missing, due to either theft or accidental loss.
As a result Britons are urged to ensure their policies fully cover their personal belongings and that they read the small print to understand the terms and conditions. Beware the cheap deal
Independent financial research company Defaqto has warned holidaymakers in the UK that some travel insurance policies are too cheap to be able to pay out in the event of a serious claim being made. The company found 30 single trip policies that charge £10 or less for a week’s travel to Europe, with one insurer quoting just £5.49 per person. In its report, entitled Travel Insurance in the UK – cheaper is rarely better, which is based on analysis of 968 travel insurance policies, it urged travellers to be wary of buying insurance based on price alone.
Brian Brown, author of the report and Defaqto’s head of insight, said: “The insurance industry and the government must do more to ensure that all consumers are aware that when it comes to travel insurance, cheapest is not always best.”

The Funny side of insurance
Only in America
A. Charlotte, NC, lawyer purchased a box of very rare and expensive cigars, then insured them against fire among other things. Within a month having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy, the lawyer filed a claim against the insurance company. In his claim, the lawyer stated the cigars were lost "in a series of small fires." The insurance company refused to pay, citing the obvious reason: that the man had consumed the cigars in the normal fashion. The lawyer sued and won. In delivering the ruling the judge agreed with the insurance company that the claim was frivolous. The Judge stated nevertheless, that the lawyer held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be "unacceptable fire," and was obligated to pay the claim. Rather than endure a lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000.00 to the lawyer for his loss of the rare cigars lost in the "fires." After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON. With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000.00 fine.
